Terms & Conditions
INTERPRETATIONS:
"The Supplier" means Elk Home.
"The Customer" means the person, partnership, firm or company which places the order request with the Supplier.
"The Stock" means the article, things or items described in the order.
"The Order" means the order request placed by the customer for the supply of goods.
"Elk Home", "we", "our" or "us" means Elk Home.
Elk Home reserves the right to change these terms and conditions at any time without notice to you and the changes will take place on the day they are posted. Any such changes will be posted on our website as an updated version of this document.
TRADE ACCOUNTS
Elk Home is a trade-only supplier and requires proof of trading before supplying any potential customer. The Customer must provide documentary proof (i.e. Utility Invoice, Letterhead etc.), as well as a fully completed trade application which can be requested from our office.
The Supplier reserves the right to reject any application they feel is not made by a ‘bona fide’ member of the trade or customers who we believe will diminish the products and/or value of the Elk Home brand.
The Supplier reserves the right to cancel trade accounts without notice.
The Supplier reserves the right to change prices without notice.
Prospective customers must declare the full trading name or trading name(s) through which they may potentially trade with us. When opening a trade account, you will automatically be signing up to our e-marketing database and its communications. To opt out of such communications, please notify us by email to sales@paulusandbrown.com
Elk Home restricts the number of online only customers retailing its products. New applications from customers without retail premises or existing customers, may be refused a trade account. We aim, but cannot guarantee, to respond to trade applications within 3-5 working days. Should we approve a customer’s trade application, an email will be sent detailing an account reference plus any special trading terms or considerations for that customer. Any special trading terms or considerations given in the account opening email form your contract with us and any dispute must be raised with us immediately by return email.
PROTECTION OF CUSTOMERS
We endeavour to protect the area for collections taken by active store-based customers within a ten-mile radius. Should issues arise with active customers and the collections taken in a geographical area, Elk Home reserves the right to withdraw a collection from sale at any point without notice.
PRODUCT DESIGN
We may occasionally alter or slightly change the design of items. We cannot accept these changes as faults. Most of our furniture is handcrafted and therefore sizes are only offered as a guide. We reserve the right to change specification without prior notice.
PAYMENTS & PRICING
We do not take payments online as it is necessary for us to check and assign your order prior to its acceptance. Payments can be made to us by faster payment or BACS. We do not accept Card Payments. BACS payments are only permissible if funds are cleared by the scheduled payment due date. If an error on pricing is noted, we will inform you of the corrected price. It is the company’s policy to comply with the Code of Practice for traders on price indications issued by the D.T.I. Consumer and Competition Policy Directorate.
MADE TO ORDER
As all items are made to order, they are unique to the customer. Materials are there for uniquely ordered and purchased to complete said order. Accordingly, our standard terms require the payment of a 50% deposit on order. Balances are due prior to despatch, once the order production process has been completed.
Production and the order lead times will commence on receipt of the deposit. Likewise, the delivery of an order will only enter planning on receipt of the balance.
Following the completion of the order, should the balance not be paid with 7 days of the balance invoice to enable the delivery, then storage charges will apply at the rate of £2 per seat, per week or part thereof, based on all items held each Monday.
DELIVERIES
Once payment has been received, the customers order will be sent for planning. Elk Home will select to either deliver the order directly or via a 3rd party nominated supplier. This will apply to either store or home deliveries. The lead time for deliveries varies per area. Elk endeavour to try and deliver all orders within 2 weeks of receipt of payment following completion of production. The South East, South West, Wales, Scotland and Ireland require an additional 7 days.
Either Elk or our nominated agent will make contact to organise your delivery once routed. Failure to accept the given delivery will result in storage charges at the rate of £2 per seat, per week or part thereof.
Delivery will be to your given delivery address, unless otherwise stated. It is the Customers responsibility of ensuring suitable access is provided and that the items ordered are able to fit into the required property.
We cannot move items inside properties which are not wholly owned by Elk Home and we are not liable for any damages incurred by our staff carrying stock on customer’s premises.
RETURNS POLICY
In the event that items of furniture are damaged, we require written notice within 24 hours of the delivery date. Any product damages must be in their original packaging. Goods returned without original packaging will not be accepted. In order to resolve any damage claim, we require that all customers submit in writing via email along with supporting clear photographs via email to sales@paulusandbrown.com.
We may send out an Elk Home representative to further assess damages if we feel it is necessary. In the first instance, we reserve the right to be able to repair any damage in the first instance. This may be on site or by bringing the item back into the factory. If we are unable to repair, then we will aim to replace if the issue is proven against Elk. If an item is proven faulty and cannot be repaired, then we would aim to replace or credit.
The Supplier is unable to accept returns for items that have not been delivered by Elk Home or via it’s nominated carrier. The Supplier will not be held responsible for any damages incurred via any third-party carrier/couriers organised by the customer or collected in person. The Supplier will only accept responsibility if they deem the damage to be caused in the manufacturing process.
When the decision to refund credit to you has been made, we will issue you with a credit note which will be applied to your account.
FURNITURE CARE
All fabrics behave differently and so in the event of stain or damage, then in the first instance it is recommended that a dry paper towel be applied to draw out any moisture prior to any attempt to remove a stain. The safest option in any cleaning is to engage in the appointment of a professional dry cleaner or specialist upholstery cleaning company. If choosing to tackle stains directly, you should always use a none abrasive cleaner, such as a wet wipe. Please refer to the care guide from the fabric producer for guidance or clarity.
WARRANTY
We offer a five year structural frame warranty against production faults only. Proof of purchase must be provided along with supporting photography and a detailed report. We warrant our products to be free of defects in materials and workmanship that result in failure during normal usage. Additional to the frame warranty, we cover all other components via a 12 month warranty, again against production faults only. The one-year warranty does not apply to furniture intentionally misused or to damage resulting from negligence, exposure, rental or commercial use, improper cleaning, unreasonable use or failure due to additional chemical treatment, or when heavy soiling or abuse is evident. The one-year or five-year warranty is not transferable.
INTERNET SELLING POLICY
Prior to listing any Elk products on any website or in any public promotions, permission must first be seeked and granted directly from Elk Home. Internet sales are a monitored and limited activity, mainly supported by retailers whom also primarily operate from a bricks and mortar store. Elk Home can supply customers with product images and lifestyle images where available to be used in all forms of marketing. At any point these images can be withdrawn and must be removed from all locations by request with immediate effect.
Images remain the property of Elk Home at all times.
Elk Home may instruct customers with products advertised online to rebrand Elk Home products at any time if the customer’s geographical area or sales platform requires this.
Customers of Elk Home must display a clearly visible working contact telephone number and full postal address on their website. Customer websites which do not abide by this rule will have their trade account closed with immediate effect.
Products can only be sold or advertised on Multi Retailer selling websites with prior written consent from a Director of Elk Home. Accounts found to be using multi retailer websites without gaining prior written consent will have their trading terms revoked and their trade account will be closed with immediate effect. Any customers found not be adhering to the internet selling policy will have their trading terms revoked and their trade account will be closed with immediate effect.
COMMON TERMS
All prices on this website and price-lists exclude VAT. Stock delivered by the Supplier will remain the absolute property of the supplier until any balance due for the stock in question has cleared into the appropriate bank account. Elk Home accepts no responsibility for a customer’s loss of profits in connection to stock purchased. Once stock is received and signed for by the customer or customer representative, they are then the customers risk and will remain the customer’s responsibility. Every effort is made to ensure that the data contained within our website is accurate however some prices, details or offers may change and it is possible that errors might occur. We will endeavour to correct any known errors as soon as we are made aware of them, but we are unable to accept any responsibility for any losses incurred. We operate according to the laws of England and Wales. If you access this website outside of England and Wales, you do so at your own risk and agree that the laws of England and Wales apply at all times. The content of this Website is Elk Home. You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us. You may not copy, reproduce, change, modify, license, transmit or sell any material or content contained herein (or supplied by Elk Home using other media) and you are permitted to use this material only as expressly authorised by us. The product designs on our website are copyrighted to Elk Home and registered with the Intellectual Property Office, and any infringement will result in legal action.

Elk Home makes no representations or warranties about the accuracy, completeness, or suitability for any purpose of the information on this Website. The information contained in this Website may contain technical inaccuracies or typographical errors. All liability of Elk Home which arise from any such inaccuracies or errors are expressly excluded to the fullest extent permitted by law. Neither Elk Home nor any of its directors, employees or other representatives will be liable for loss or damage arising out of or in connection with the use of this website and the purchase of products from this website (your statutory rights are not affected). This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
